In the 1900 case The Paquete Habana, the U.S. Supreme Court held that customary international law regarded small coastal fishing vessels as ordinarily exempt from capture during armed conflict. However, the 1907 Hague Convention (XI) on Restrictions with Regards to Right of Capture in Naval War stated that such fishing vessels “cease to be exempt as soon as they take any part whatever in hostilities.” Why do Kraska and Monti believe that China’s maritime militia, which consists of almost 200,000 fishing vessels, may subject certain of those vessels to capture?
